That's what courts are for - deciding issues.

It seems to me that the companies can refuse to sell the drug OTC if they believe it requires MD supervision/scripting. If they sell it OTC they take with the benefits the risks of a suit.

I do not believe for one second that companies would resist OTC status for a drug if they made more money by selling OTC.

Everyone is driven by the almighty buck. The HMO's want OTC because it saves them money. Insured consumers want scripts since it is cheaper. Duh!

There are many policy issues inherent in the FDA forcing drugs OTC. The disruption of a well understood economic model for drug development funding is at the top of my list followed closely by a disincentive for creating safe drugs.
