Didn't have to tell Bush/Cheney/Powell, et al. They were well aware of it, plus 1441, plus Saddam's ongoing violations of the '91 ceasefire agreement. There are so many legal arguments that could and have been made for removing Saddam either collectively or unilaterally that your point is moot.
