David, I wish you the best in your investing but I will post what I stated I would post on Monday and then I am out of here. This analysis has gotten to levels lower then my niece's report that her sixth grade class presented on the stock market. And I am dead serious. David, I don't want to verbally attack you but you're the guy who insisted I was related to the company and even went as far as saying that I could be the CEO after I posted very clearly that my relationship to AVIR is nothing more then being long the stock. Since you couldn't comprehend that simple fact how in the world are you going to follow logic that is a weee bit up the food chain. YES, I posted Sturza's comments and that I thought that H&Q released their report shortly after the phase III clinical ,but you tell me how this is GROUNDS FOR A LAWSUIT that your friend has hinted. THAT IS MY POINT and you couldn't follow let alone understand what really quallifies for a breach of NASD rules. David, do you really have confidence in the point that just because you couldn't find a required fed filing such as a 10Q or 10K that AVIR is delinquent. Have you even called the company as they will be sure to send you what has been filed and if they have been delinquent I promise you that you would have heard the day that they failed to file. The rules are that the Q must be no latter then 45 or 60 days[forget] from the ending date of the quarter, and the K must be filed no longer then 90 days from the end of their respective fiscal year. Common sense would tell you that if AVIR was out of compliance there would be no way that they would have the underwriters support and in the process of a secondary that involves a great more of additional filings. I will post on Monday all of the filings that appear as insider selling and see what % are from officers and directors or of no relation to AVIR. David, I wish you and your friend good luck in all of your investments but there is a real learning curve and dues that need to paid that you will accomplish with the passage of time if you are serious about being a smarter, wiser, and more analytical investor. This has nothing to do with AVIR success or failure rather it's wisdom that you will gather with time. I say this not becasue I am anything to write home about but rather I have achieved some embarassing failures and some impressive successes,with the successes that have been recognized nationally in the past 20 yrs that were a result of trying to improve my abilities on a daily basis. There are some very bright individuals that post on SI that you and your friend could learn by and I am not necessarily referring to myself, and it would do you both a great service to read and listen. I'm sorry for the lecture but do wish you the best. GOOD LUCK.
