I would say that a guy with these credentials is presenting one side of the Legal argument. I don't have the Legal BG to say it's wrong, John. I would say, as a Libertarian, that it's wrong. But not legally. I don't think you have the legal BG either.

Who said anything about the legal stuff. I routinely consider that Scalia makes wrong decisions; as does Thomas; etc. I've seen enough of the legal stuff to know it's about like a lot of areas of expertise. The experts disagree, vehemently, and each argues their position well. So what do you do? Read up as much as you can, then see where folks reasoning goes wrong. In George's case, it's my view that he went wrong when he converted a privacy case into a marriage case. And he did so because of his own personal animus to homosexuality. So there.
