This was but one of many red herrings. Rumsfeld kept changing the rules trying to find something, anything which would make the Iraqis look bad to help justify the oil grab. There were U2 flights, demands for documents known to be destroyed, and the destruction of missles which were borderline specs at best. There was never a chance that Iraq could have avoided the invasion, this was a war of naked agression, not of some intransegence by Saddam.

Edit- remember how Junior or Rumsfeld wouldn't ever say what Iraq had to do, they just used the vague word "Disarm" so there was never the chance that the Iraqi's would ever comply.
