I haven't seen the Bloomberg article but have seen others talk about the same process, including Chuck Carlson some time ago. The problem with doing this is that it pisses off the companies, and can lead to abolition of discounted prices for longer-term investors. Sure, it's a legal loophole, but I am starting to see firewalls against this tactic, including the company's right to terminate your participation in the plan if they find you doing that. In truth I support them in controlling this because it helps keep companies in the plans for us smaller investors.
