A move above the neckline is a warning sign; a move above the right shoulder negates it. Another warning sign is a break of the downtrend line across the head and right shoulder.

The failed H&S top in the S&P in March-October 1999 is a good example of a negated H&S:

On the other hand, the Nikkei neckline of 1987-1992 was penetrated repeatedly without being negated.
