Protectionism is a term used to describe the behavior of a sovereign nation using its domestic laws in order to protect its own industries. One example of a recent form of protectionism are the steel tarriffs imposed by President Bush on all imported steel.

The banning of commercial use of freeware (or shareware) through the legislative process would be akin to the efforts in the pharmeceutical industry to regulate the production and distribution of generics. There is nothing illegal or anti-competitive about it. It's as American as cherry pie.

This is a problem IMHO that is bigger than any one company. It is hurting the entire industry, with the exception of bottom feeders like Mike Dell.
