Sorry, but marriage constitutes an enforceable contract, and the dissolution of a marriage raises issues that can often only be adjudicated by the courts. Therefore, it is unavoidable for the state to decide what it will consider a valid marriage, and to offer a means to register marriages to those without religious affiliation. That there is a ceremony attached is merely customary, and irrelevant to the main point.
