That would be a great thing. However, the Democrats and their cash cow Trial Lawyers Association will never allow that to happen. Their argument is what you are already pleading: the "underprivileged" will not have equal access to the courts, since trial lawyers won't want to be involved with loser-pays if they would be on the hook for part of that liability.
