I can see the ATLA's point that anyone trying to take on a deep-pockets corporation could be wiped out in an instant if they lost a lawsuit. However, perhaps a loser pays law could be modified to hold the loser accountable for a cap of $x per day per each lawyer the loser hired. In other words, if I hired two lawyers to take on MegaCorp, and MegaCorp in turn hired a dozen lawyers and trounced me, I'd only have to reimburse MegaCorp for the time of two of their lawyers. Going pro se would be treated as having hired one lawyer.

Another alternative would be to adopt a uniform state and federal anti-SLAPP procedure. This way, any party that contends it is being unfairly or maliciously prosecuted could get a quick ruling from a judge to that effect. If successful, they would then get reimbursed for their legal fees and, if they so choose, sue for malicious prosecution and the like.
