What evidence do you have that Thomas is not bright?
Hmm, the usual. First, the absence of evidence that he is bright. He rarely says anything save for echoing Scalia. Second, the opinions of his I have read are certainly nothing special. Certainly not as compared to say Scalia or Souter. You can see good minds at work in each case. And, in Ginsberg, Breyer, Stevens, and O'Conner, the little I've read of their opinions, they appear to do their homework. Third, though I haven't read his opinion in this case, the observation that he cited few if any case law and referred only to his own experience, certainly doesn't offer evidence of smarts.
As for his grades at Yale Law School, I have no idea. |
