"Hurtful speech" is not a free speech issue. It's a "hurtful speech" issue.


Yeah, this is the College's excuse for stifling free speech, John, but it is nonsense. The first amendment reads:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

There is no exception in there for calling people names, John. "Hurtful Speech" is a recent University addition. All of these academic speech codes are illegal. The ACLU would be leading the fight against this if they weren't a bunch of Academics themselves. So the Conservative and Libertarian Foundations have to do it. I think several cases are winding their way up the ladder, and eventually, the Supremes will have to rule on it.

Hey, they might go your way, they certainly did on AA. It would be humorous if it were not so tragic that the very people who are installing and enforcing these codes on campus were out there with Mario Savio fighting for free speech in the '60s.
