The last section of Scalia's opinion was textbook Scalia, confrontational and mean spirited.

If you want to insist that black is white, so be it. Just shows me how far apart we are, John. Keeps our point/counterpoint going.

This decision, along with Rowe/Wade, shows why we now have the terrific struggle over the courts. They have taken over what used to be political decisions, made by legislatures. So the legislatures know they have to get control of them.

O'Conner and Kennedy are writing very bad law, with their, "This Daisy, no not that Daisy", decisions. Two more Justices, and this will change.
