STATEMENT OF RELATED PROCEEDINGS

Defendant and Respondent Philip Berber is one of seven defendants named in the Complaint filed in the Superior Court of California for the County of San Francisco on October 11, 2002. One additional appeal and two petitions for writ of mandate are pending before this Court.
On May 20, 2003, Plaintiff and Appellant Olivier L.F. Asser filed Notice of Appeal of the March 20, 2003 order of the Superior Court granting the motion of the Investment Advisory Defendants Christopher Rea and Trading Places, Inc. to quash service of process and dismiss on personal jurisdiction grounds. The appeal has been assigned to Division Three, under Case No. A102812. The Appellant’s Opening Brief and Appendix is, as are documents in this appeal, due July 16, 2003.
On May 30, 2003, Appellant filed two Petitions for Writ of Mandate, seeking reversal of the March 21, 2003 orders of the Superior Court granting the motions of the two sets of Brokerage Defendants, Manhattan Beach Trading, Inc. and Terra Nova Trading, LLC, and CyberTrader, Inc. and the Charles Schwab Corporation, to compel arbitration and stay further proceedings. The petitions are pending before Division Three of this Court, and have been assigned respective Case No.’s A102731 and A102735. In both cases, the Court requested the Brokerage Defendants address all issues raised by the petitions in opposition briefs to be filed with the Court. These were filed by the defendants on June 17, 2003. Appellant understands rulings on the petitions to be pending.
