It's not a minorities case, because sexuality has not been determined to be a protected class. If sexuality is a protected class, then child molestors are protected as well.

It's pretty clear which mindset you are working out of, Derek. I'm sorry to see it.

Consensual sex between adults in the privacy of their homes and apartments is not even close to child molestors.

I thought the reasonable demonic picture your group wished to throw at this reasoning was the horror house of gay marriage. I've not read Kennedy terribly closely but I would hope you are right. And that there are six votes now, given O'Connor's different equal protection reasoning, for it. I doubt it. And we'll just have to see.

The good thing is that Bowers is history. At least until your friends ratchet up the conflict levels to appoint someone like Scalia.
