Are their rights protected. For example, if an antheist couple gets married in a civil ceremony, in the eyes of many religions, they are living in sin. However, the rights of the couple are still protected (e.g. health care, inheritance issues, hospital visitation, etc), even though their marriage is considered invalid by a number of churches.

So, why does the law protect the rights of a married atheist couple and not a married homosexual couple (note: there are churches, albeit small independent ones, that will perform and recognize such marriages)?
