Nope. Nice try. He's going at it from a, to put it as nicely as possible, rabid right wing conservative, Scalia take. I'm going at it from a humane, inclusive, justice seeking point of view. Hmm, can't remember the exact way I put it in a previous post. But you get the point.

But more seriously, Derek's not the "legal" way; it's a fairly constricted, narrow interpretation of the constitution. IN that interpretation, the Constitution is not seen as a protector of minority rights over against majoritarian democracies.
