I told him I gave him an A+ for determination and perseverance. I also stated early on it was unfortunate he lost so much money.

As far as stock picks. The office I was at paid Pristine just as anyone else would, whether an individual or a group. Sometimes I'd trade a pick and other times I'd pass. I was not forced to trade 10, 20, 30, ... times per day.

Sure I was and I paid my "tuition" along the way. Just because I'm still here today doesn't mean I've not taken some big hits along the way.

Nor do I. But if that's your position then you should address those remarks also to Countofmoneycristo (Olivier). I'll not go back and dig up excerpts but there are plenty of instances I could cite.

I'm sure I know as many people as you who lost a LOT of money. But many of those who lost money chose to not sell when the market meltdown started. That's unfortunate. Sadly, buy and hold mentality over the past few years was a disaster for many people.

But there are certain aspects of the case that make little, if any, sense. For example it was stated:

< 46. In exchange for those fees, plaintiff reasonably expected to receive trading advice calculated to return to him profits from day trading activities. >

Given that 90% or more of day traders fail why would this individual, who subscribes to a stock picking service, (that I doubt had any lengthy history of picks) expect the positive outcomes above? Why should he expect to be one of the few who profit from day trading?

Last, and then I'm leaving ... the plaintiff seems to want to recover his $10 million and perhaps more, if I read things properly. That to me would suggest that he doesn't hold himself accountable for any of his losses. And that is truly sad. We always have, and likely always will, have people who choose to not take responsibility for their own choices and actions.
