In the case of mal-practice suits, those deals are causing major problems in rural communities. MDs are moving out of states with worst history of huge settlements.
I was recently called for jury duty & it involved just such a lawsuit. The man & wife were suing a doctor because they claimed after the man was injured at work & treated by this MD, the doctor mistreated his injury which was the fracture of a teeny tiny bone in the man's wrist. The husband & wife were suing for lost wages for yrs in the future since their lawyer stated that the man could no longer work. He looked like a perfectly robust & healthy person to me. We were involved with another pressing project at the time & I begrudged the 3 days & endless testimony & countless xrays that were to be presented about the teeny tiny bone. So, I raised my hand & expressed my feeling that many lawyers encourage far too many of these frivolous lawsuits. The man's lawyer, Guido, asked me if I could remain unbiased if I was chosen for the jury. I indicated that my feelings would probably cause me to be prejudiced in the MDs favor. Guido quickly moved on to another subject & needless to say, I was not chosen--happily for me.
