Yes I am. Seems my ship has a gaping hole in it now right
along the water line. It seems it was a friendly fire
incident that is going to be covered up.

As you know from our private discussions, no one wants to
look into it or make Workman's Compensation take
responsibility. This includes the Inspector General,
politicians or the media. Almost everyone I have shared
this with isn't in the least surprised or outraged.

But as captain of my ship, I did everything I could to get
this resolved fairly & justly.

I worked within Workman Comp's system so that I could get
proper & timely treatment of a severe injury that occurred
while I was hundreds of miles from home working my ass off
as a civil servant.

I played by their rules. I provided them with a trail of
evidence that was as rock solid as any of the fraud cases I
worked as a federal auditor, all of which resulted in a
successful outcome. And I did have a distinct advantage
over Joe Six Pack. I had spent the previous 13+ years as a
Federal auditor at two different agencies. I knew how to
read & interpret their laws & regulations. I knew how the
system worked. I knew what they were legally compelled to
do & what evidence I needed to provide to force Workman's
Comp to capitulate or defend the indefensible.

I clearly exposed the horrific dereliction of duty by my
case workers. I proved I was repeatedly denied due process.
I proved I was repeatedly & illegally denied medical
services, treatments & benefits.

I proved that my physician provided clear evidence of an
ongoing injury-related impairment, including permanent
nerve damage. I proved that his prescribed therapy & follow-up
examination were illegally denied (he was going to
prescribe an MRI if therapy did not rehab my knee & we now
know I had a torn meniscus, so no amount of therapy would
heal it). I proved that Workman's Comp had no legal right
to force me to see their doctor while simultaneously
rejecting all of the evidence of an ongoing injury-related
impairment that my physician had provided.

I proved that their doctor submitted a blatantly false
report that was based on an orthopedic examination that
this doctor never performed (he even resolved my permanent
nerve damage without performing any tests at all - he just
called it "alleged" nerve damage).

I proved that all reports pertaining to my case were filled
with lies & disinformation. I proved that these reports
completely ignored &/or dissembled all evidence that showed
I still had an ongoing injury-related impairment. I proved
these reports covered up evidence of numerous instances of
wrongdoing by my case workers.

I proved that numerous laws & regulations were violated in
order to keep me from receiving a proper diagnosis. I
proved that numerous FOIA requests were illegally ignored.
I proved that the Privacy Act was violated repeatedly by
them to keep me from obtaining access to the documentation
in my file.

In my 13+ years as a Federal auditor, I saved taxpayers
many tens of millions of dollars exposing fraud by
presenting evidence to prosecutors in quite a similar
fashion to the evidence I presented to Workman's
Comp in my appeal.

Yes, I took sole responsibility for myself & worked within
their system. I left Workman's Comp with only one logical
legal conclusion; that terminating my legitimate claim
would be completely improper. Workman's Comp somehow
managed to ignore all of my evidence as though I had
remained completely silent in my appeal. They blithely
concluded that I had long ago fully recovered from
my 'contusion' by relying solely on their doctor's
fraudulent report & ignoring all evidence my physician & I
had provided. Workman's Comp closed my claim with prejudice.

My claims examiners got their bonuses for saving Workman's
Comp money based on how they handled my claim. Our health
insurance must now pay for all costs related to my injury.
I get to live with all the additional damage to my knee
that happened by not having it properly treated in a timely
manner.

You'll have to excuse me if I take a little time to stew
over the events of the last 3 1/2 years. I've had plenty of
experience turning the other cheek, dusting myself off,
picking myself up & moving on. Unfortunately I'm having a
harder time getting up this time with this permanent damage
to my knee.
