I would prefer they throw it out.

Have you really considered what this would mean? For children, for example; for legal protections of people choosing to live together; for intestacy laws; for many, many other quite mundane but societally important aspects?

Or maybe you really do believe that family law lawyers need a huge boost in their incomes, which would clearly be one consequence of the elimination of marriage.
