the crew was not engaging in hostile behavior to begin with but perception was far more important than actual intentions of the crew. If ship would indeed be hostile (as it was perceived) then the intentions of the crew would not be so clear cut

re: by the German courts for shooting shipwrecked sailors
that was WWI, in 1960's the same German court acquitted german officer in charge of hanging Jewish children (12 and and below). The court concluded that if the hanging was not done in cruel and unusual way then it was within the rules of war.

re: shipwrecked sailors, prisoners of war, civilians in occupied territories
1) the sailors of Liberty were not shipwrecked
2) Israel goes through a great leangth not to hurt civilians
In fact if US would be in place of Israel US would level all suspected areas from the air.
