Now here's a good question: Going back three years, I have been unequivocal about these charges. I've accused a number of the defendants of crimes, felonies. On December 1 and 4, 2000 counsel to MB Trading and Terra Nova Trading warned me against libel and defamation - in writing. But they never did anything, took no action. They did say that they "value [their] good name (the brokers) and that they would "take appropriate action to address such meritless conduct." But nada. Why not? We are talking here about individuals and firms in the aggregate worth billions of dollars. Why don't they go ahead and sue me? because there's no money in it? They must be concerned that these allegations might have cost and might be costing them millions in revenues, so why not go to court and clear their "good names"?
The answer is a simple one: if they had done nothing wrong, then they certainly would. But, because they are guilty as sin, the don't dare. They have moved to avoid the California courts, every last one of them, because they are scared to death of what a jury might say about what they did. They know very well that if they sued me anywhere, then they would waive certain rights to argue against jurisdiction, to force me before a biased panel, and that then I would as sure as the sky is blue hit them with gigantic counter-claims. And the last thing they would ever want is that these claims wind up before a court and a jury.
Jon, Jorj, I think maybe you'll want to explain why they have not taken such action, if there are no claims, and if it's all just hot air. Why fear the courts? As one poster here said a few years ago: "I never met an honest man who feared the judgment of a jury."
Maybe the defendants hope to use some of the posts here from SI. They may. When they do, they'll waive my introducing certain posts into the proceedings, including their running and hiding like the dogs they are from a jury. They wouldn't want that, because they realize that in many ways that comes very close to an admission of guilt. Honest people are not afraid of courts and juries. Dishonest people run for their lives, desperate to avoid that judgment. No, they want to be where they control it all, like NASD arbitration. I have warned them that whatever happens to my claims, even it means in some ways sacrificing them, I'm going to make sure they're hauled in front of a jury. Considering their moral compass, they likely could never imagine anyone making that kind of sacrifice on principle, but I intend to, if it becomes necessary.
One thing that won't happen in this is that they get away with what they did without an accounting. No chance. So, Jorj, when we discussed whether or not I win, there can be a number of ways, and not every last one of them involves me receiving all of the relief prayed for in the Complaint. There are other ways I will walk away satisfied. |
