This evening on C-Span I listened to Justice Rehnquist talking about Justice Jackson's prosecution at the Nuremberg Trials.

He said that many wanted the defendants to be summarily executed, or receive a military tribunal at best. But Jackson wanted to develop a record that would show the ages that we had done the right thing.

He said that if we simply passed them the poison cup, one day we would be treated the same.

I found that resonant. I know the legal arguments about terrorist defendants and have made them myself but I find myself troubled by some of the things Ashcroft proposes, as well as some of the things he does.

Nevertheless, most of the things you read about the Patriot Act are written by folks unschooled in the law. If you read something written by someone lettered in constitutional criminal law and procedure, then take it seriously.
