I'm not sure I agree with your assessment of why harassment laws were put into effect, but I'll agree with the general premise.
The fact that I told an off color joke wouldn't have created any legal problems, either, EVEN IF someone complained. I know because it's happened before (I am still stunned about how sensitive people can be about the most inane things). Simply put, the issue is whether people are willing to say something to your face or whether they feel it requires going to HR. In the case in question, the person went to HR and I promptly apologized, which cleared the issue up. However, I followed up with a lengthy letter from my lawyer that pointed out that there was no need for the person to have gone to HR UNLESS they confronted me first and I refused to apologize, OR if this kind of behavior was constant and habitual on my part (though it's happened before, it isn't constantly occurring).

Sensitivity is the issue, as far as I can tell. Though I agree with your assessment of the inefficiencies that it often created.
