faces DNA test in paternity case

A Plymouth County judge yesterday ordered a Roman Catholic priest to undergo genetic testing to determine whether he is the father of two adult siblings who have filed a paternity suit against him.
Probate and Family Court Judge James V. Menno denied a request by the Rev. James D. Foley, 69, to dismiss the lawsuit. He said Foley must submit to a DNA test to settle the paternity issue for James Perry, 38, of Middleboro and his sister, Emily Perry, 32, of Stoughton.
``The defendant, in church records and in the media, has admitted to a sexual relationship with (the Perrys') mother during the probable period of their conception and has acknowledged the birth of the two children, whose ages he knows with specificity, from this relationship,'' Menno wrote in his decision.
``Having revealed enough circumstantial evidence to effectively sever the plaintiffs' previously unquestioned confidence in their biological ties to the man who raised them, (Foley) refuses to take the final step of acknowledging the plaintiffs as his own children,'' Menno cited as his reason for ordering the testing.
The Perrys' mother, Rita, died of a drug overdose in her Needham home in 1973 at the age of 41.
According to published reports, Foley has apologized to the Perry children for his involvement in the affair with their mother, but refused the DNA test unless the Perrys signed a waiver precluding them from filing any more lawsuits.
Attorneys for Foley and the Perrys could not be reached for comment yesterday. |
