The Defense of Marriage act says they are NOT married for federal purposes.

So they can be married under a state law, but not under federal law.

So if they live in a state with a state income tax, they file their state taxes as married but their federal taxes as single. And if they have a child, one of them gets to choose to be the head of household and file as such.

If they alternate that year in year out, the IRS is going to get very confused!!
