The Citizens' Indictment can lead to the full investigation and prosecution of officials in the Bush/Cheney government from Dick Cheney on down.

And if the President is not impeached and tried while he is in office, he can be indicted after he leaves the White House.

This project originated with the journalist and writer Ronnie Dugger asking what a citizen in a democracy can do to stop his national leaders from proceeding on their own declaration that they have the right to wage wars of aggression. While impeachment is of course an option, only the House of Representatives can impeach a President and the House is now under the solid control of the party whose President and Cabinet have asserted their right to wage wars of aggression.Using the Google search engine, Dugger first looked up "citizen arrests." As a practical option in this situation, however, these are obviously impractical, melodramatic, and even dangerous. Are there such things, he wondered, as citizen indictments? On Google he found only one precedent for these, a Citizens' Indictment signed by ten Norwegians asking prosecution of the foreign minister in Norway for his conduct during the course of the wars in former Yugoslavia. Google yielded up no precedent in U.S. history.Consulting with a distinguished constitutional lawyer and other attorneys, Dugger satisfied himself that a seated President cannot be indicted while in office, but that any other federal official, from the Vice-President on down, can be indicted while in office, consistent with the Constitution. Concerning the Agnew precedent, Nick Biddle, a college professor, historian, and writer and a colleague of Dugger's, conducted timely corroborating research.
About 150 persons attended a conference last spring in Detroit at the University of Detroit, Mercy, on the national political emergency that has been precipitated by the Bush Presidency. Dugger read to the group his draft, as of April 30, 2003, of the Citizens' Indictment and Draft True Bill. That afternoon people began signing it.The Hon. John Conyers, Congressman from nearby Dearborn, Michigan, and the ranking Democrat on the House Judiciary Committee, entering the hall as Dugger was finishing, followed him to the rostrum and gave a rousing endorsement of citizens coming together as they were doing and actually seeking remedies for the crisis the country is in. At one point Conyers asked who in the group favored impeachment of the President and to all appearances everyone present raised an arm high.

investigate, impeach, and try George W. Bush, Richard B. Cheney, Donald H. Rumsfeld, Paul Wolfowitz, Colin L. Powell, John Bolton, George Tenet, Condoleezza Rice, Richard B. Myers, Tommy Franks, John David Ashcroft, Tommy G. Thompson, and Gale A. Norton for the crimes, high crimes, and misdemeanors of which they are here accused and concerning which Congress adjudges that they should be tried. But the action we demand does not wait or depend on what Congress does or doesn't do. We are urging citizens to take a Citizens' Indictment and Draft True Bill to their home-base district attorneys and grand jurors and ask them to consider investigating and filing charges preparatory to trials of the accused officials, except for the time being the President, before juries of twelve men and women good and true.
