If one sincerely thinks there is a First Amendment issue, I can hardly object to litigation. Not liking it, though, does not make it a First Amendment issue, so I suppose it depends on what you think the issue is, whether it should be taken to court.

As I have often said, I do think that it is a constitutional issue, although not by a big margin. But I think it's also an issue of civility that could and should be worked out without having to press the constitutional aspect of it. I don't know what those who actually took it to court think, but I assume that, given that I think it a constitutional issue and given that the court ruled it a constitutional issue, that those who filed also thought so and were acting in good faith.
