Keyes takes that issue on directly, calling it erroneous. He relies on the erroneous doctrine, repeatedly affirmed by the Supreme Court of the United States, that the First Amendment forbids an establishment of religion, and that the 14th Amendment applies this prohibition to the states. His essay is actually a direct assault on the validity of the doctrine of incorporation. Using the exact language of the 1st, 10th and 14th Amendments, he presents a case for obviating the "well-established" incorporation of the establishment clause.
