If you can get that agreement, more power to you.

For example: "Do you solemnly swear to tell the whole truth and nothing but the truth, so help you God.

Believer: If I lie, it will be judged as a sin against my soul by the God who creates, sustains, rewards and punishes me for eternity...

Non-believer: Well, I promise deeply to tell the truth as long as I see no benefit in lieing and little or no chance of being punished either way. What do I care if they attach the "so help me God" part on the end. In fact, it gives me more leverage than my gullible opponent.

Based on this argument the religiosity in the Courts actually favours non-believers, in the winning/losing cases scenario.
