Corporations are using the L-1 visa program to bring in cheap labor and replace American workers. Theoretically, the visa allows a multi-national corporation to bring into the U.S. employees from their overseas subsidiaries on an “intra-company transfer” basis. In fact, companies are abusing the program and replacing their American workers with cheaper foreigners. Currently, there is no cap on the number of L-1 visas that can be issued per year.
HR 2702 would place an annual cap of 35,000 on L-1 visas and deny L-1 visas to any company that has laid off an American worker within the last six months. The legislation would also mandate that L-1 visa workers be paid prevailing U.S. wages. (Watch for further information on this issue in the next CAPS newsletter.)

POINTS TO MAKE

• During this economic downturn it is unfair to replace American workers with cheap, foreign labor.
• In some documented cases, American workers have had to train their foreign replacements before being laid off.
• This legislation is especially important for California. The state’s large technology sector has suffered and many tech workers are already unemployed.
• The L-1 program currently has no caps. Companies are using it to get around the very limited safeguards of the H1-B visa.
