I would agree with you, cessation of resistance is not determinative. That's the old and now discredited theory of rape -- no bruises, no rape.

OTOH, there is a manner in which consent can be given not in words but physically.

An aside, I am noticing here a difference between the responses of parents who have daughters and those who don't. We're too small a sample for this to be meaningful as a trend, but it's interesting.

In my case, I have both a son and daughters. I have a strong compulsion to protect my daughters from being raped, either traditionally raped or date raped. OTOH, I don't want my son jailed for life for rape because of an ambiguity on a woman's part which after the event she decides to call rape.
