News from Olivier: I've been very busy.
I filed against my former atty's on August 8 in DC federal court. Very bad news for their hopes of getting away with what they did to me and everyone who trusted me to follow through for them too - the public claims - that I won the writs. A lot of law firms were awaiting those results, because obviously that victory gives me some credibility. The stats are that less than 5% of writs are granted. And coming from someone not a lawyer I'll bet that drops to under 1%. I'm sure Terra Nova and Schwab's lawyers were appalled ;-).
So, now we are going to have ourselves a little trial where everything is going to come out. That's not what they wanted of course. Better to cover it all up through arbitration where nothing is made public, records are closed. With the COA decision a huge can of worms just got opened. About time.
The case against my former atty's now of course just got a big boost. Where they lose everything, someone never having gone before a higher court ever, a non-lawyer to boot, wins before an appellate court where all odds are stacked against you. They have got serious problems how to explain that. In a short while that's going to get worse for them, as there are other decisions coming from the Court of Appeal.
The RICO action. Everyone in the first suit is named plus we've got: Steve Demarest and Ross Ditlove from MBT. Gerald Putnam from Terra Nova. Bentley who traded against TP clients through offshore accounts. The clearing firms Southwest and Penson who if some of you don't know . Counsel to Terra Nova and Cyber who knew all about the kickbacks, helped the brokers try to get away with them - totally improper. Bill Young of TP who arranged the kickbacks and met with Berber in Texas. That's right, I said many times that I didn't post everything I knew. Well, here's one indication. This TP officer arranged it all and admitted it to me and my former lawyers - in specific detail. Oops. Now I imagine he has been pressured into shutting up but it's too late. He can now decide if he wants to commit perjury and obstruct justice in federal court. We'll see if he does. Wouldn't be smart though.
By the way, Chris Rea has NOT filed a brief in the appeal. He's got until Sept. 22 or he could be sanctioned and lose the appeal. I wonder if he is still in the country. Maybe he's fled to Turks and Caicos? I would not be surprised one bit. Lot of people probably very annoyed with him for his decidedly un-clever blatant perjury.
The motion for sanctions I filed was denied. I asked whether or not the judge would refer criminal charges against Terra Nova for what they did with IRS and Virginia. I asked because the Offices of the District Attorney and the Attorney General told me they had to get the green light from a judge where civil cases are concerned. The judge told me he couldn't do it. Then he said something really funny: "You can only do that in civil law countries." I guess he knows I come from a Dutch family, lol.
Terra Nova tried to block me from naming Demarest, Ditlove and Putnam in this action and the judge refused to change his earlier ruling. He said, "All previous orders remain in place." So that solidifies that order.
