There seems to me to be an inconsistency in your post.

You say "As a result, the woman has no cause to press rape charges (I said so earlier.) nor does the man have cause to whine if rape charges are pressed. Would I convict him? Of course not."

If you wouldn't convict him, then no crime of rape has happened.

But then later you say "Having said that, I think the final onus needs to be on the man in questions of rape for two reasons..." That implies that you WOULD consider a situation of dubious consent to be rape.

Please clarify.
