Yes, they're both stupid. And deserve each other.

I guess I am getting into the legal vs. social question again. Heck, I'm a lawyer -- I was indoctrinated into that thinking. I guess you're saying one can have rape by social standards which isn't criminally punishable as a crime. I can go along with that if that's what you want to assert.

And I won't get exercised however the matter is resolved or not resolved.

Since if he is convicted of rape there is an enormous social cost -- in a date rape case you remove a presumptively contributing member of society who is presumptively paying taxes and will keep doing so for years to come and instead impose a tremendous financial burden on society of keeping a man in prison, at a cost to the taxpayers of perhaps $25 grand a year plus construction costs of the prison sell which can be substantial, and that may, in some states, last the rest of his life -- forty or fifty years since they may have been fairly young at the time. If society is going to spend a million bucks or more keeping this guy locked up, I think the taxpayers should at least have a sense that they're getting what they want for their money.
