What is important is that, absent a compelling state interest, he should be left to decide whom he wants as a client.

I have never argued otherwise.

The mechanics of it are not important.

The mechanics are important if he has a freedom to decide that he cannot exercise because there is no feasible way to exercise it.

The mechanics are also important if he inappropriately targets the class of clients he wants to exclude, for example, if he wants only clients who can afford to pay so he excludes black clients.

The mechanics are also important if he opts to exercise his freedom in a way that ruins his business.

The first and last are important only to him. The middle one is important to all of us.
