Jewell's hypothetical as far as I can tell assumed a message therapist who had a successful business without women clients and asks should he be forced to have clients of both sexes or no clients at all. The issue could become important for this hypothetical masseur if after having a successful business for some time, someone sued for discrimination threatening the business. Tim
