Those who disagreed with it view it as political, those who agreed with it view it as based in law.

I'm talking about a different issue and that's the degree to which the narrative about judicial decisions at this level is increasingly that they are only political and, more important, we see no shame in that. The kick start decision for this narrative is the Gore v Bush decision.
