That's the point.

Any court action in favor of the voters and fairness should have either stayed out altogether in favor of states' rights, or if there was any grounds for intervention should have ordered counting of all the ballots.

There's no mystery, even tho' the proponents would like to make it mysterious. Historians have already started to show this decision in a bad light. Any Calif activist intervention will make it worse.
