Wow...that was pretty good. There are a few interjections I might like to add but over all I think you have captured the issue.

"The prospect of getting a regulation passed to honor his freedom of conscience is daunting."

Yes.

"Alternately, he could take a stand on conscience and challenge the industry standard via civil disobedience, take the penalty, and in doing so publicize the shoddy industry standard and the impact of discrimination laws on the safe practice of massage therapy. Now, that would be a noble and heroic thing to do."

Actually, we might have to force this upon him by sending you and X to get a massage. Chris can stand their with his ball bat or what ever he wants to pull out of his…never mind.

"Obviously, society cannot give a general exemption for conscience. It would have to decide each claim for freedom of conscience individually."

I agree. It is incumbant on the person of conscience to qualify his position. Remember I offered a stab at qualifying the position "freedom of conscience." Society maintains its role in judging the issue in a culture where freedom of conscience is a protected liberty (I think there is room for improvement)….here it is:
Issue of conscience: An issue of conscience should be founded upon some genuine grounds of not wanting to cause harm to self and others, or to do good for self and others. The person must be able to define the faculty (issue of conscience) that enjoins the circumstance with his/her grounds. Evidence should be available that support this position of conscience for this particular individual. It must be supported by ones outlook on a variety of circumstances and it must have been displayed and persisted for a significant amount of time. In the event that some life changing experience has brought about this issue of conscience, it should be supported by authenticating evidence.
