Mojo could declare his position at the time of licencing and petition the boards on the "freedom of conscience" issue. A government agency should definitely be the judging entity. If he doesn't do this at the time of licencing but he is challenged by you and x or by some internal professional entity, he should have the right to appeal to the government agency for an exemption. I assume that the petitioner would submit his side in his petition and the state would evaluate the impact and make a recommendation on whether or this would be a net benefit to society. Not on net benefit to society. Although, they might want to know if he is using this vehicle to cause harm to some person or group. Their recommendation beyond that would be based simply on whether or not he has satisfied the issues raised in the definition of protection of freedom of conscience. "Interesting idea. Never happen, but interesting nonetheless. " Agreed.
