Turn it into a class action and you'll have many join you I bet. But the statute of limitations may have run out on this and damages are probably not so significant to make it worthwhile.

On the other hand, I'd be more interested in Brinker's mishandling of the QQQ blunder. Damages there would be massive. In that case, I'd love to have an independent party determine if Brinker has a model, evidence for it's existence and what that model was indicating at the time of the QQQ trade. If Brinker was recommending a buy on QQQ while the model turned bearish that might be grounds for false advertising.

Or it might just be grounds for the most stupid tip ever given.
