Your case is, I think, different because the victim was not in the process of committing a crime, and because the guy presumably climbed the water tower with the intent to shoot people, so it was part of a plan he was carrying out. Both things make it different. Your guy, yes, gets tried for either murder or manslaughter, probably murder.
