Are you basicaly arguing that Mojo has an explicit or implied contract if he sets an appointment with someone or even puts up a sign advertising his services and saying "just walk in no appointment needed"?

I might agree in the first case, probably not a contract that would be legally enforceable or that even should be enforced but atleast a commitment where by failing to live up to the commitment could reasonably be considered causing harm. I'm not so sure about the second.

Also what if Mojo sets up appointments explicitly to discuss if someone should be his client rather then for the performance of services? Or what if Mojo only performs services for people he knows well?
