You need to look up the word "schumerism". The 9th circuit has some good judges but they are in the minority. The good judges there write some terrific dissenting opinions before the Supreme Court smacks them around a lot. If there is no judicial activism, how is the Pledge of Allegiance unconstitutional, where is the right to abortions in the constitution, where is the word privacy in the constitution? Those aren't in the constitution---when something is NOT in the constitution, whatever it is, the constitution is very clear--its left to the States to decide, not the Federal Government. But what do the activist judges do--they make Federal rulings giving the Feds powers not given them.
