I could be wrong but Robertson may be taunting the government to try just that. He could then challenge the Patriot Act versus free speech all the way to the Supreme Court using the American Center for Law and Justice. Jay Sekulow of the ACLJ has argued free speech cases before the Court before and won. If the government does nothing it's probably because they don't want their unconstitutional Patriot Act challenged in court at all. And the publicity surrounding the case would raise public awareness of the Patriot Act and make it impossible for them to ever get PA II passed which is dead in the water now anyhow. It would be a long and difficult battle for the government and the Constitution is not on their side.
