Of course. Provided the legislatures do so with due regard for the rights of individuals.

While it seems almost simplistic, the unspoken assumption the majority of the court made in Roe v. Wade was that it was impossible to grant legal status to an embryo, then allow abortions. Nevertheless, the Court did recognize that there are limits, holding that in effect the older an embryo becomes, the higher the state's rights vis-a-vis the woman's.
