I want to clarify: under the circumstances, even if Mojo has a right to refuse service to females, he does not have a right to cause someone to rely upon a contract with him, knowing that there is an impediment to fulfillment. Therefore, it all turns on how responsible he is for the confusion. Since he did not solicit the business, and the name could easily be mistaken as masculine, I am not sure that he has any liability, but I suppose an argument could be made that if he books under those circumstances, he ought to exercise more care than was shown. Anyway, it is not structured so that freedom of conscience is relevant as a defense........
